State Plan Amendment anticipated implementation date: ​7-1-2020 

CSNO has been working to move the State Plan Amendment (SPA) forward for anticipated July 1, 2020 implementation date. The new SPA expands LEA Medi-Cal reimbursement services to EPSDT (as defined by the Periodicity Schedule), assessment and medically necessary treatment services. The SPA expands provider types, types of services and removes the 24 capped services. Students with general education treatment services must have a physician's order and an IHP.

California Healthy Youth Act (CHYA)

b. The CDE is working on guidance that will be posted on the CDE webpage  to help answer questions and address concerns districts are experiencing across the state and CHYA implementation   
Meanwhile, please see below for updates and resources regarding the California Healthy Youth Act’s mandated Comprehensive Sexual Health Education, per guidance from CDE:
·       Districts/schools cannot simply skip the California Healthy Youth Act mandated instruction for MS and HS this year, despite the many challenges with delivering this sensitive education in a distance learning environment. 
·       Districts can postpone the sexual health education.  If districts find it too difficult to implement comprehensive sexual health education in a safe and appropriate manner for students this year, they can elect to move the education to next year.  For example, if they were providing the education to 7th graders and 9th graders, next year they can provide it to the 7th and 8th graders, as well as the 9th and 10th graders.  CDE is advising that districts come up with a thoughtful plan for that will look like, but it is permissible. 
·       CDE is advising districts to check with their curriculum publishersregarding any adapted content that is ready for distance learning use.  For example, Advocates for Youth have moved their free curriculum, Rights, Respect, Responsibility, to Google Classrooms (click here to request access).   
·       Districts must inform parents of the new delivery model for sexual health education- if they are moving the content to online, via paper packets, etc.  Parents must be allowed to opt their child out of the education if they find the new delivery model unsuitable (may be due to home environment, access to resources, security issues, etc.).  If districts have already processed parent notification letters with opt out instructions, those should be re-issued with the updated information and parents should be allowed an opportunity to:
o   Review the instructional materials to be used in the new distance learning structure (tip: check with your curriculum publisher, many are offering zoom meetings to walk parents through the materials).
o   Be provided 14 days’ notice before the new instruction begins or is resumed so they can exercise their option to opt out their child, if necessary.

·       Districts need to be aware of potential filter settings on devices that may inadvertently block access to appropriate sexual health education content and/or LGBTQ+ related resources and websites.

​Immunization Guidance During COVID-19

CDPH issued a letter to Vaccine Providers for Children (VFC) on March 27, 2020 with recommendations regarding Routine Childhood Immunizations during COVID-19 Pandemic. Key takeaways from the letter: 

  • Prioritization of immunizations for children 0-24 months
  • Strategies for modifying clinic operations
  • approval for alternate/temporary VFC locations

The March 20, 2020 statement posted to the ShotsForSchools website states: 
"Even with current school closures, immunization requirements for admission to school or child care in California for the 2019-2020 or 2020-2021 school year remain in place."
